Reed's Rules and the "nuclear option"
"Tyrany of the Minority"
That is what Thomas Reed, a representative from Maine, called the filibusters of the minority Democratic party in the House of Representatives in the late 19th century. The attempt of a minority group to hold sway over the will of a duly elected majority with bureaucratic loopholes. He felt this was in direct opposition to the spirit of a democracy. Thanks to Reed's leadership as Speaker of the House, the filibister was effectively removed from the "traditions" of the House of Representatives during his tenure. Reed's Rules can be perused here.

Just some food for thought as things heat up in the Senate. The Republicans may have finally realized how much power they have right now, and how desperate the Democrats are to prevent their full nelson on the Judiciary from slipping. I think we'll see some really dramatic fireworks reminiscent of Reed's time over the next few months as the Senate is allowed to freely debate the appointment of qualified judges and then attempt to vote on their appointment. If there is a filibister attempt, that's when the most common substance in Washington DC will hit the fan.
